TERMS AND CONDITIONS

1. SCOPE AND VALIDITY OF THE TERMS AND CONDITIONS

These general terms and conditions (hereinafter the Terms) of the online store of Scantank OÜ (hereinafter Seller) apply to all persons (hereinafter the Buyer) who use the scantank.ee online store (hereinafter the Online Store), order goods and services (hereinafter the Goods) from the Online Store, including entering into a contract of purchase and sale for the purchase of Goods from the Online Store (hereinafter the Contract of Sale). Upon accepting the Terms, the Buyer confirms that they have familiarised themselves with the terms and conditions of the Contract of Sale, accepts the terms and conditions, and shall comply with them.

2. PURCHASE OF GOODS AND ORDERING FROM THE ONLINE STORE

Goods with a link “Add to cart” can be purchased from the Online Store. The price and availability of the Goods are subject to change without notice. If the Buyer has placed an order before the price of the Goods changes, the price valid at the time of the order shall apply.

2.1. Shopping cart and order finalisation

The quantity of the Goods in the shopping cart may be changed. You can read the terms and conditions of the Online Store and confirm that you accept them by ticking the box in front of the terms and conditions. To confirm the order, the Buyer must click on the “Submit order” button and the Buyer will be directed to the payment method page where the appropriate payment method must be selected. The Buyer can also change the payment method in the last stage of the order. Enter the Buyer details and press the button “Next”. Then, the final payment method selection will be displayed. This is necessary for confirming the Order and completing the purchase. The Buyer can choose the payment method and pay for their purchase. The sales contract is deemed to have been concluded upon receipt of the invoice amount due to the Seller’s bank account. The Seller shall not fulfil an outstanding order.

2.2. Price information and payment for goods

The currency of the Online Store is the euro (€). Prices include VAT. The prices of goods are subject to change without notice. The Seller shall not be liable for any other taxes or fees that may be applicable to the Buyer and for which the Buyer shall bear full responsibility. The following payment methods are available: by invoice or via Internet bank (Maksekeskus AS), which includes bank links to Swedbank, SEB, Nordea Bank, Danske Bank and LHV Pank. After making the payment, the e-shop will send the Buyer an Order Confirmation and an invoice. All personal information that has become known during the visit and purchase at the Online Store shall be treated as confidential information. Data communications channels with banks are encrypted to ensure the security of the Buyer’s personal data and bank details. The Seller’s representatives do not have access to the relevant encrypted data.

2.3. Delivery of products

The delivery of the products will be agreed on between the Seller and the Buyer after the purchase. The Seller shall prepare a quote for the Buyer regarding the delivery. The Buyer is not obliged to accept the quote. The Buyer may also organise the delivery at their own expense.

2.4. Right of withdrawal.

The Buyer has the right to withdraw from the contract (refrain from using the product or service) within 14 calendar days after the product or service was made available, i.e. the user has been sent the user name and password. In order to withdraw from the contract, the Buyer shall submit a withdrawal application. The Buyer can submit a withdrawal application to info@scantank.ee. If the Buyer has withdrawn from the contract, scantank.ee shall refund the cost of the order to the Buyer within 14 days as from the submission of the application for withdrawal. Refunds will be made to the Buyer to the same bank account that was used to pay for the order.

3. PRINCIPLES OF DATA PROTECTION AND PROCESSING

The Seller guarantees the protection and use of the Buyer’s data, including personal data as provided in the terms and conditions of the Privacy Policy. The Buyer confirms that they have read and agree to the terms and conditions of the Privacy Policy. Subject to applicable law and to the terms of the Privacy Policy, the Seller has the right – without the Buyer’s consent – to process data (including personal data) to the extent necessary for using the Online Store, perform the Contract of Sale or ensure the performance of the Contract of Sale. Owing to these aforementioned rights, the Seller has the following rights without separate consent: send notices to the Buyer regarding the use of services of the Online Store, including notices sent in the interests of safety of the Online Store users; retain information of orders placed by Buyers logged into the Online Store, including those orders that the Buyer did not complete during a session within reasonable time to provide a better service to the Buyers and verify transactions.

4. LIABILITY

The Buyer is solely responsible for the security and use of his/her username and password required to use the product or service. Each use of the Buyer’s username and password shall be deemed to have been entered by the Buyer and the Buyer shall be responsible for all activities that occur under that username. The Buyer confirms that they use the products and services purchased from the online store at their sole responsibility. The Seller shall not be liable for any damages to the Buyer or third parties arising from the use of the products and/or services purchased from the online store.

5. VALIDITY OF THE TERMS AND CONDITIONS

These terms and conditions become valid on 01/09/2019.

PURCHASING INFORMATION

1. ORDERING

• Select the products or services you want to buy from the online store and add them to your shopping cart.
• By opening your shopping cart, you can adjust the quantity of products and delete products from the shopping cart.
• Once you have added all the products to your cart, press CONTINUE CHECKOUT.
• All fields marked with an asterisk (*) must be filled out in the order.

2. PAYMENT

After placing the order, it can be paid for either by invoice or with bank transfer via bank links provided by Maksekeskus AS. The invoice will be forwarded to the buyer’s email after the order has been placed.
